Our Work Is Embedded In The Legal Framework

Our work is embedded in the legal framework of Sint Maarten and is carried out on behalf of institutions responsible for decision-making, enforcement, and oversight. J&IS does not operate in silos, but works in close coordination with its partners to ensure coherent, effective, and timely interventions.

Through this mandate, J&IS provides independent professional advice, supervision, and guidance that support lawful, proportionate, and effective interventions.

Our Partners Within The Judicial Chain Include:

No single organization can address complex justice, child protection, and social challenges alone. J&IS works closely with judicial authorities, government agencies, treatment providers, educational institutions, law enforcement, employers, community organizations, and other stakeholders to deliver coordinated and effective support. Through strong local, regional, and Kingdom partnerships, we promote rehabilitation, strengthen child protection, and build safer, more resilient communities.

The Prosecutor’s Office (OM)
Is responsible for leading criminal prosecutions, deciding on charges, and requesting probation advice, reports, and supervision to support prosecutorial and judicial decision-making.
The Court of First Instance of Sint Maarten (ZM)
Adjudicates criminal and civil cases, imposes sentences and protective measures, and relies on probation and family guardianship reports for informed and enforceable court decisions.
Corps Police St. Maarten (KPSM)
Is responsible for law enforcement, criminal investigations, and maintaining public order, and collaborates with J&IS on enforcement, information sharing, and coordinated responses to risk situations.
The Prison and House of Detention
Executes custodial sentences and pre-trial detention, ensures safety and order within detention, and cooperates with J&IS on rehabilitation, reintegration, and release planning.
The Parole Board (CCR)
Assesses submissions for conditional release, advises the Minister of Justice on parole decisions, determines parole conditions while, and relies on J&IS for risk assessments, progress reporting, and supervision of clients released under parole conditions.
Court of Guardianship (CoG)
Conducts initial child protection investigations after a report, advises the Court, works closely with J&IS on the execution of child protection measures, and coordinates the transfer of youth probation cases to J&IS when minors turn 18.
The Ministry of Justice
Sets overall justice, rehabilitation and child protection policy, provides the legal and regulatory framework, mandates statutory services, and oversees the functioning of justice institutions.

These partnerships are essential for addressing the underlying causes of offending and family challenges, supporting rehabilitation and reintegration, protecting vulnerable children and families, and promoting long-term positive outcomes.
